Bayham Zoning By-law Review - Shaping Our Future

The Municipality of Bayham is undertaking a Zoning By-law Review to update the Bayham Zoning By-law Z456-2023. Please see Notice.

A copy of the current Zoning By-law – Consolidated December 18, 2025 and the associated Schedules are available for review and comment.

The Zoning Bylaw implements the policies and objectives detailed in the Official Plan. It outlines how a specific parcel of land may be used and regulates matters such as lot size, parking requirements, building height, landscaping requirements and other site-specific factors.

A new Municipality of Bayham Official Plan was adopted on April 2nd, 2026. Municipalities are required under Section 26 of the Planning Act to update their Zoning By-law to ensure they conform with the Official Plan.

The purpose of this Zoning By-law Review is:

·         To ensure the regulations are in conformity with the new Municipality of Bayham Official Plan and the Planning Act,

·         To review recent trends in Zoning By-law Amendment and Minor Variance applications and revise regulations as appropriate, and

·         To modernize the regulations set out in the Zoning By-law, improving clarity and useability of the regulations, streamlining appropriate development, and addressing issues with interpretation and enforcement.

What will change in the new Zoning By-law?

The Province of Ontario has made significant planning policy and land use changes over the last several years, which have been incorporated into the adopted Municipality of Bayham Official Plan, while implementing the community’s vision for future change and development. The Province of Ontario has also updated the Planning Act to require or prohibit how Zoning By-laws regulate several matters. These changes now need to be implemented in the new Zoning By-law.

Further, the current Zoning By-law was approved in 2003, and revisions are required to modernize the regulations, improve clarity and useability of the Zoning By-law, streamline appropriate development, and address issues with interpretation and enforcement.

This Zoning By-law Review is a municipal-wide initiative and affects all lands within the jurisdiction of the Municipality of Bayham.

The community is invited to share ideas about their needs for the Municipality and requirements to ensure efficient land use, development and growth. We encourage your comments now and throughout the Zoning By-law Review process. Comments may also be made verbally or in writing at the planned Open Houses or at the Statutory Public Meeting.

One-on-One Appointments are available with the consultant team and Bayham Staff. At this time, meetings will be held virtually, however, in-person meetings at the municipal office in Straffordville can be accommodated where appropriate. Meetings

A Special Council Meeting will be held on Thursday, May 28, 2026 at 6:00 PM in the Municipal Council Chambers 56169 Heritage Line, Straffordville to formally initiate the Zoning By-law Review project, whereby Staff and the consultant team provided an overview of the process, estimated timelines, initial issues for review, and future opportunities for participation. Project Milestones

The following provides the project phases to complete the Zoning By-law Review project:

·         Phase One – Project Initiation (April - May 2026) – CURRENT PHASE

The Zoning By-law Review project is formally initiated by Bayham Council. Staff and the consultant team will provide an overview of the process, estimated timelines, initial issues for review, and future opportunities for participation. Council will be invited to add to the list of issues for review.

·         Phase Two - Consultation and Policy Review/Analysis (June 2026 – January 2027)

The Municipality and consultant team will host a virtual Open House for the public, stakeholders, and agencies to provide an initial opportunity for comments on topics or issues that should be considered through the Zoning By-law Review process. The consultant team will also be available to consult one-on-one. The Municipality and consultant team will develop options to address the issues raised and seek further direction where appropriate at a Council meeting at the end of this phase.

·         Phase Three – First Draft of Zoning By-law (January 2027 – June 2027)

The first Draft Zoning By-law will be prepared based on the comments received during consultation, as well as the reviews completed in Phase Two. The Draft Zoning By-law will be presented at a Statutory Open House and posted online for additional public, stakeholder, and agency comments. An approach to transitioning the significant number of site-specific regulations over to the new by-law will also be presented, with implementation of this approach to follow in the next phase.

·         Phase Four - Final Draft and Approval of Zoning By-law (July 2027 – October 2027)

Following the commenting period on the first Draft Zoning By-law, changes to the draft document will be incorporated into the document along with the site-specific regulations before being brought forward at a Statutory Public Meeting. The public, stakeholders and agencies will be able to provide comments. The consultant team will also be available for one-on-one discussions on the transitioned site-specific regulations as needed.

The final Draft Zoning By-law will then be presented to the Municipality of Bayham Council for approval.

Appeals

If a specified person, public body, or registered owner of any land to which the plan would apply would otherwise have an ability to appeal the decision of the Corporation of the Municipality of Bayham to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written Zoning By-law is approved, the specified person, public body, or registered owner of any land to which the plan would apply is not entitled to appeal the decision. 

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Bayham before the Zoning By-law is approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
